These Terms of Service (“Terms”) govern your use of Fabl, including our website, applications, and related services.
By using Fabl, you agree to these Terms.
If you do not agree to these Terms, do not use Fabl.
1. About Fabl
Fabl is an AI storytelling platform for creating consistent, long-form video. We provide tools to generate and edit video content, subject to these Terms and the credit available on your account.
2. Eligibility and accounts
You must be at least the age of majority in your jurisdiction to use Fabl.
You are responsible for maintaining accurate account information and for maintaining the security of your account and any login methods used to access it. You are responsible for all activity that occurs under your account.
3. Your content
You retain ownership of the content you create with Fabl. You grant us the limited rights necessary to host, process, and display that content in order to operate, provide, and improve the service.
You are responsible for ensuring you have the rights to any material you upload and that your content does not infringe the rights of others or violate applicable law.
4. Faces, likenesses, and photographs of real people
Some Fabl features let you upload photographs and apply a real face to a generated character. Where you use them, you confirm that you have permission from every identifiable person in the photograph, including permission for their face or likeness to be used to generate new images. If the person is not you, obtaining that permission is your responsibility.
You may not use Fabl to depict a real person without their authorization, including a public figure, or to present a real person as saying or doing something they did not.
Facial images may be treated as biometric information under some laws. Our Privacy Policy explains how we handle them. Where your local law requires consent before that information is processed, obtaining that consent is your responsibility.
We may remove content and suspend accounts where we reasonably believe the required permission is missing.
5. Acceptable use
You agree not to:
- Misuse or interfere with the service
- Attempt to gain unauthorized access to systems or accounts
- Scrape, reverse engineer, or copy the platform
- Use automated methods to overload or disrupt the service
- Use Fabl for unlawful, harmful, or abusive purposes
- Create content that infringes intellectual property or other rights
- Upload a photograph of a person who has not consented to their likeness being used
- Depict a real person without their authorization, or present them as saying or doing something they did not
We may suspend or terminate accounts that violate these Terms or interfere with the operation of the service.
6. Credits and payment
Fabl is usage-based. You add credit to your account and spend it when you generate.
Planning is free. Uploading a script, building a project plan, and refining it are not charged. Charges begin when you generate visual output.
What credit is
Credit is a prepaid balance held against your account. It is not currency, carries no cash value, and may not be transferred between accounts or workspaces, sold, or exchanged for cash except where required by law.
Expiry
Credit you purchase does not expire while your account remains open. Promotional credit, including the credit granted to new accounts, expires 60 days after it is granted. Where your balance holds both, promotional credit is spent first.
What consumes credit
Credit is deducted when a generation starts, not when it finishes and not when you are satisfied with the result. A single request may produce several outputs, and each output consumes credit. Reusing something you have already generated — for example applying a saved entity from your library to a project — generates nothing and consumes nothing.
Because credit is deducted up front, a generation that fails has already been charged. We do not return credit because a generation completed and you did not like the result. Where a generation fails for a reason on our side, contact us through our contact page and we will review the charge.
Price, currency, and tax
Current rates are published on our pricing page. Prices are in US dollars and exclude any applicable tax, which we add where required. We may change our rates. A change applies to credit purchased after it takes effect and does not alter the value of credit already on your account.
Payment and refunds
Payments are processed through third-party providers such as Stripe. You authorize us to charge your selected payment method for the credit you purchase.
Purchased credit is non-refundable except where required by law. Credit remaining when your account closes, or when we terminate your account under section 12, is forfeited unless applicable law requires otherwise.
7. Intellectual property
The Fabl platform, including its software, design, and branding, is owned by Fabl and protected by intellectual property laws.
Except as expressly permitted, you may not copy, distribute, modify, reproduce, or create derivative works from the platform without prior written permission. These Terms do not grant you any rights to our trademarks or branding.
8. Service availability
We work to provide a reliable experience, but Fabl is provided on an “as is” and “as available” basis. We may modify, suspend, limit, or discontinue features at any time.
9. Disclaimers
To the fullest extent permitted by law, the service is provided without warranties of any kind, whether express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that it will meet your specific requirements.
10. Limitation of liability
To the maximum extent permitted by law, Fabl and its affiliates, owners, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the service.
To the maximum extent permitted by law, our total liability arising from or relating to the service will not exceed the amount you paid to Fabl during the twelve months preceding the event giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless Fabl, its affiliates, owners, employees, contractors, and service providers from and against any claims, liabilities, damages, losses, and expenses arising from your misuse of Fabl, violation of these Terms, or violation of any law or third-party rights.
12. Termination
You may stop using Fabl at any time.
We may suspend or terminate access to Fabl if you violate these Terms, if we reasonably believe your use creates risk or harm, if required by law, or if necessary to protect the service or other users.
Termination does not affect outstanding payment obligations or provisions that reasonably should survive termination.
13. Privacy
Your use of Fabl is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect personal information.
14. Changes to these Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use of Fabl after changes become effective constitutes acceptance of the updated Terms.
15. Governing law
These Terms are governed by applicable law, without regard to conflict of law principles. Any disputes will be resolved in the courts of competent jurisdiction where Fabl operates.
16. Feedback and suggestions
If you submit feedback, ideas, suggestions, or comments about Fabl, you agree that we may use them without restriction or compensation to you. This avoids confusion about ownership of product suggestions.
17. Waiver and severability
If we do not enforce a provision of these Terms, that does not mean we waive our right to enforce it later.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
18. Entire agreement
These Terms and our Privacy Policy constitute the entire agreement between you and Fabl regarding your use of the service.
